I hope I am reading this incorrectly. Is USCIS now saying that any applicant on AOS must obtain an AP for travel, even if they are on H1B... The post above me is infintely correct if this is the case.. I hope I am wrong in my interpretation

I have filed on August 10th and I do not have a receipt either. I guess we need to be patient. I have checked even people with July 19th are waiting.

This is precisely why my Lawyer (amongst the top) advised to maintain H1B (so keep filing for extensions).
If your H1 expires and you are here based on AOS 485 > and for some reason 485 gets rejected you are out of status.

I am a Citizen that is petitioning my husband of 5 years. We received a letter in March'08 to be present at an interview in Charlotte, NC. We gathered all of the required documentation to provide. Once there, and called in with the Immigration officer, we began our interview process. She was satisfied with all of the information, and tangible proof, we provided. She asked my husband for his passport in order to stamp his I-551 and that meant we were approved. Unfortunately, my husband's passport had been expired for some time and she could not stamp it. What do we do? He works and it will cause heartache and financial stress if he looses his job as the company has strict rules about what documentation you must present in order to remain employed. Please help. Since we have not received a letter from USCIS and the status is still pending, we are unsure of what we should do at this point. Any information you can provide will be greatly appreciated.

Thanks, You are right I havent applied for my I485 yet. I am only concerened about when I return back to US, will there is any issues at POE due to my long absence on H1B?

You can't maintain H-1B status while physically residing in India. But, you can still have your GC process running.
An absence won't be of any consequence as long as the visa is valid and you are employed by the same employer.

Did anyone get their GC Approvals from USCIS Local Offices which are pending after the interview is complete? If anyone is waiting for local office cases what is the process they are following and how is the approval process?
I am waiting for my approval of my EB2 India with PD Nov 2004. it is pending in San Jose Local office

"approvable" is the right term.
what if there is an rfe on the 140 when the case is not approved (but is approvable) and the employee has already quit? wont the 140 sponsor have to respond saying that employee nada exists? so, even though "approvabe" may be the right legalese, isnt "approved" more practical and relevant for us as beneficiaries.

My attorney didn't pay attention to my birth certificate. My birth was registered couple of days after later but the certificate was issued 4 years later in 1979. And my fathers, mothers and my names were not full name. My fathers name was spelt wrong. Anyways nothing can be done now my application went in on July 2nd. I am hoping it will be an RFE. My case is another classic case of Attorney negligence.

I worked for some time on OPT and then went back to work in India.
I came back in 2005 , the immigration situation being very bad with retrogression I applied for canada immigration from US ( from india
there is a severe backlog...canada has a per immigration visa post backlog unlike us which has per birth country backlog)
I recently got Canada PR , I joined the MBA here at U of Toronto.
Had I been in my early 20s I would have thought about US imigration.
Nowdays it take 7 to 8 years ....thats more than 10 to 15% of your productive life.
I have talked to my friends ( from IIT delhi ) all of them have same opinion...its a lost cause
now. Now that theyhave invested 5 years they dont want to quit.
Only 1 in know who did MS in US and got GC. Rest were all PhD who got GC through EB1.
EB2 , EB3 is all dead now.
Now it too late I need to settled . How can I marry with the insecurity of moving from place to place in search of contract project, bodyshopper eating avay 30% of your billing rate etc.
I have given up hope. There are challenges in Canada as job market is
not that great but atleast I can sleep at night without having to worry
about the immigration. Ihave one more friend working in Canada he also moved from US.
The salary rate etc is lot lower in fact. On the whole Canada is hard for foreign educated...

I believe unless you filed I-485 under the revised fee structure last year, you need to pay for EAD and AP renewal every time you have to renew.

The cutoff date for EB2, India, retrogressed by two additional years, to January 1, 2000. Moreover, the prediction contained in the Visa Bulletin for EB2, India, is that the annual limit could be reached within the next few months. Hello All, Pardon me if I'm bringing up the question that's already been answered, but couldn't find any answer anywhere in the forum.
I just received my FP notice today but my wife hasn't received any. I'll wait few more days certainly before calling USCIS, but has anybody come across this situation? We had mailed all the applications together at NSC and have Receipt Notices.
Does InfoPass come to any help here?
Please suggest.
Me and my wife recieved our FP notcies 4 days apart. i would say wait for a week before calling USCIS, but make sure you call before your appt itself. Also you can check with your attorney whether they have recieved the FP notice
